As per South Africa’s Protection of Personal Information Act (POPIA), we use the following terms to describe different types of visitors and users of our Site and Services. This privacy policy tells you how we use personal information collected at this site. Please read this privacy policy before using the site or submitting any personal information. By using the site, you are accepting the practices described in this privacy policy. These practices may be changed, but any changes will be posted and changes will only apply to activities and information on a going forward, not retroactive basis. You are encouraged to review the privacy policy whenever you visit the site to make sure that you understand how any personal information you provide will be used. Note: the privacy practices set forth in this privacy policy are for this web site only. If you link to other web sites, please review the privacy policies posted at those sites.

Collection of Information
We collect personally identifiable information, like names, postal addresses, email addresses, etc., when voluntarily submitted by our visitors. The information you provide is used to fulfill you specific request. This information is only used to fulfill your specific request, unless you give us permission to use it in another manner, for example to add you to one of our mailing lists.

Cookie/Tracking Technology
The Site may use cookie and tracking technology depending on the features offered. Cookie and tracking technology are useful for gathering information such as browser type and operating system, tracking the number of visitors to the Site, and understanding how visitors use the Site. Cookies can also help customize the Site for visitors. Personal information cannot be collected via cookies and other tracking technology, however, if you previously provided personally identifiable information, cookies may be tied to such information. Aggregate cookie and tracking information may be shared with third parties.

Distribution of Information
We may share information with governmental agencies or other companies assisting us in fraud prevention or investigation. We may do so when: (1) permitted or required by law; or, (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; or, (3) investigating fraud which has already taken place. The information is not provided to these companies for marketing purposes.

Your personally identifiable information is kept secure. Only authorized employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information. All emails and newsletters from this site allow you to opt out of further mailings.

PAYMENTS

All trips/tours/products  must be paid for before the trip commences, in the event of advance bookings payment must be made by the due date indicated on the invoice. If payment is not made by the due date GKA reserves the right to cancel the booking. 

All prices are indicated and payable in South African Rand by cash or EFT unless prior arrangement is made for alternative payment. 

BOOKINGS 

It is the responsibility of the customer/booking agent to ensure that they book the correct trip/tour/product. 

All quotes from GKA remain valid for 30 days after date of quoting and are liable to change if the booking is not confirmed in that time period. 

Although we do our best to ensure that all tours/activities/products are run in accordance with the itinerary/product description there is the potential that changes may need to be made due to circumstances outside of our control. In these instances, we will do all we can to keep the tour/activity/product as similar as possible to the itinerary/product description 

Bookings confirmed by email are considered binding and are liable to cancellation fees. 

CANCELLATION POLICY

20% fee of total tour/activity/product cost applicable to cancelations made 30 days or more before starting date. 
50% fee of total tour/activity/product cost applicable to cancelations made 29 to 8 days before starting date. 
100% fee of total tour/activity/product cost applicable to cancelations made 7 days or less before starting date. 
 

In the case of advance deposits/payments made by GKA to 3rd party suppliers of accommodation, activities or products the booking agent or customer responsible for the booking made through GKA will be liable for any cancellation fees to the 3rd party/parties. 

In the event that a tour/activity/product must be cancelled due to uncontrollable circumstances (including but not limited to: dangerous weather, protest activities, family emergencies, health issues, health risk, fire, airport closures, industrial disputes and similar circumstances) GKA will offer a free transfer of date which may be transferred to friends or family members at no extra cost or alternative tour/activity/product, if this is for some reason not possible we will offer a refund to the customer/booking agent minus reasonable costs to GKA depending on the circumstances of cancellation.

WEATHER

Many of our products are weather dependent for safety reasons. We advise that customers be aware that weather related cancellations are a reality and out of our control and are only executed for reasons of safety to our guests. In the event of weather related cancellations, we will do our best to offer an alternative tour/activity/product or reschedule the tour/activity/product. We are more than happy to advise on the best options for the season or which is the best season for the tour/activity/product which you are interested in. 

LIABILITY

GKA has liability insurance for all tours/activities/products offered however we do strongly advise that guests have their own insurance in place when participating in any of our tours/activities/services. Many of our tours/activities/products take place in outdoor environments and include road transport where certain dangers and risks are always present. Though we do take every precaution to ensure the safety and comfort of our guests GKA does not take any responsibility or liability for any persons or their belongings or equipment for any reasons whatsoever. Our full indemnity and liability policy can be viewed on our indemnity form (DOWNLOAD) which all guests will be required to sign before participating in any of our tours/activities/products.  

DOMICILE EXECUTANDI  

All possible disputes arising from our terms and conditions are subject to South African Law and any hearing of cases will take place in a South African Court of Law.  

 

SAFETY REGULATIONS

It is the responsibility of the customer/booking agent to ensure that guests booked for tours/activities/products have the necessary fitness level to participate in the tour/activity/product for which they are booked (if you are unsure please feel free to ask us and we will do our best to assist.) 

All guests/customers are required to follow the instructions of GKA guides and staff while participating in any of our tours/activities /products.  

GKA reserves the right to decline accepting or retaining any traveller whose health or actions in GKA’s sole judgement impede the operation of a tour/activity/product or the welfare or enjoyment of fellow travellers. The decision of GKA guides/staff members as to the conduct, itinerary and objectives of the tour is final. If in the opinion of GKA guides/staff members your behaviour or physical condition is detrimental to the safety, welfare and well-being of the group as a whole (which are the paramount considerations), or if the GKA guides/staff members considers your general well-being will be put at risk by continuing with the trip, you may be asked to leave the tour without the right to any refund. 

Our smallest life jackets and floatation devices are rated for persons over 20 kilograms. If a parent/guardian wishes to bring a child under 20 kilograms on a kayak trip/rental they must ensure to bring along their own floatation device for said child. Children 12 years and under are required by law to wear personal floatation devices.

VOUCHERS

All vouchers are valid for 1 year after date of purchase/receipt, are subject to availability and booking/confirmation of date in advance is essential. Not redeemable during high season.
